Introduction

These Terms and Conditions (“Terms”) govern the access to and use of the website, applications, platforms, and communication services (“Services”) provided by Kasat Group of Companies, having its registered office at 7 & 11, Nest Oro, Opp 70 Gala, Mahim Rd, Palghar – 401404, India. By accessing or using our Services, you agree to be legally bound by these Terms, applicable laws of India, and all related policies referenced herein.

Kasat Group of Companies operates as a technology-enabled service provider offering business communication, automation, messaging, and digital solutions, including services enabled via WhatsApp Official Business API and Rich Communication Services (RCS) platforms.

Definitions

  • “Company” refers to Kasat Group of Companies.
  • “User” / “You” means any individual, business, or legal entity accessing or using our Services.
  • “Services” include messaging platforms, APIs, dashboards, integrations, support, and related offerings.
  • “Third-Party Platforms” include Meta (WhatsApp), Google, telecom operators, and authorized vendors.
  • “Content” means messages, data, templates, media, and materials transmitted through the Services.

Acceptance of Terms

By registering, accessing, or using any Service of Kasat Group of Companies, you confirm that you have read, understood, and accepted these Terms. If you do not agree, you must discontinue use immediately.

Use of WhatsApp or RCS-based services additionally requires compliance with respective platform policies.

Description of Services

Kasat Group of Companies provides enterprise communication solutions including, but not limited to:

  • WhatsApp Official Business API integrations
  • RCS messaging services
  • Customer communication automation
  • Notification, transactional, and support messaging
  • Campaign management dashboards
  • API-based messaging solutions
  • Related technical support and analytics

Services may evolve, be enhanced, modified, or discontinued at the Company’s discretion.

Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have legal capacity under Indian law
  • Be authorized to represent your business (if applicable)
  • Use the Services only for lawful purposes

The Company reserves the right to refuse service at its discretion.

Account Registration

Certain Services require account creation. You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Notify us immediately of unauthorized access

Kasat Group of Companies shall not be liable for losses arising from unauthorized account usage.

User Responsibilities

You agree not to:

  • Send spam, fraudulent, or misleading messages
  • Violate WhatsApp, RCS, or telecom regulations
  • Transmit unlawful, abusive, or harmful content
  • Use purchased databases or non-consented contacts
  • Circumvent platform safeguards or restrictions

You are solely responsible for message content and recipient consent.

Payment & Billing Terms

  • Fees are payable as per agreed pricing plans
  • Payments are non-refundable unless explicitly stated
  • Taxes (GST or others) shall be borne by the User
  • Delayed payments may result in service suspension

Kasat Group of Companies reserves the right to revise pricing with prior notice.

Subscription Renewal & Termination

Subscriptions may auto-renew unless cancelled. Either party may terminate services with notice. Upon termination:

  • Access may be disabled
  • Outstanding dues remain payable
  • Data retention follows the Privacy Policy

Violation of policies may result in immediate termination without notice.

Use of WhatsApp Official API & RCS

Users acknowledge that:

  • WhatsApp and RCS services are governed by their respective platform policies
  • Message approval, delivery, and pricing are subject to platform rules
  • Kasat Group of Companies is not responsible for platform-level restrictions or changes

Failure to comply may result in suspension by third-party platforms.

Message Delivery & Compliance Policy

Message delivery is best-effort and dependent on:

  • Telecom operators
  • Platform availability
  • Recipient device/network conditions

The Company does not guarantee delivery, read receipts, or response rates.

Intellectual Property Rights

All software, trademarks, logos, dashboards, documentation, and proprietary systems belong to Kasat Group of Companies. No rights are granted except limited, revocable usage rights during service term.

Confidentiality

Both parties agree to maintain confidentiality of non-public business, technical, and commercial information, except where disclosure is legally required.

Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis. Kasat Group of Companies disclaims all implied warranties, including merchantability and fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Kasat Group of Companies shall not be liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or business opportunities.

Indemnification

You agree to indemnify and hold harmless Kasat Group of Companies from claims arising due to:

  • Your misuse of Services
  • Violation of laws or platform policies
  • Content transmitted through your account

Governing Law (India)

These Terms shall be governed by the laws of India. Courts located in Maharashtra, India shall have exclusive jurisdiction.

Changes to Terms

Kasat Group of Companies may modify these Terms periodically. Continued use constitutes acceptance of revised Terms.
